These Terms of Sale (the "Terms of Sale") apply to any purchase, subscription, or paid plan for the PawTracker software-as-a-service platform (the "Service").
The Service is provided by Aurélie Duynslaeger, trading under the commercial name Motion Lab, a French sole proprietorship (micro-entreprise), SIRET number 937 550 333 00010, having its registered address at 3 avenue Albert Bourgois, 59390 Sailly-lez-Lannoy, France ("PawTracker", "we", "us", or "our").
These Terms of Sale supplement our Terms of Service. In the event of any conflict or inconsistency between these Terms of Sale and the Terms of Service, these Terms of Sale shall prevail strictly with respect to subscription, pricing, billing, and payment matters.
The Service is made available exclusively for professional, commercial, and business use by pet care professionals (including dog trainers, behaviorists, pet sitters, boarding facilities, and daycare operators).
By subscribing to or purchasing a paid plan, you represent and warrant that you are purchasing the Service solely for business purposes and not as a consumer. Consequently, statutory consumer protection laws, including consumer withdrawal rights and cooling-off periods, do not apply to your purchase to the fullest extent permitted by applicable law.
PawTracker offers two primary pricing structures as of the Last Updated date:

All prices are displayed and billed in Euros (€).
Pursuant to Article 293 B of the French General Tax Code (Code Général des Impôts), VAT is currently not applicable to PawTracker's invoices. However, you are solely responsible for any local taxes, sales taxes, use taxes, goods and services taxes (GST), or value-added taxes (VAT) that may be levied by your local tax authorities in connection with your purchase, as well as any currency conversion or foreign transaction fees charged by your financial institution or card issuer.
PawTracker reserves the right to modify its pricing structure at any time for new customers.
All billing and payment transactions are securely handled by our third-party payment provider, Stripe. PawTracker does not collect, store, or process raw payment card numbers or credit security codes. Your payment details are transmitted directly to Stripe in compliance with Payment Card Industry Data Security Standards (PCI-DSS).
By submitting your payment information, you agree to comply with Stripe’s legal terms and privacy policy governing transaction processing.
For Monthly Subscriptions, you explicitly authorize PawTracker (via Stripe) to automatically charge your designated payment method on a recurring monthly basis on the same day of each month (the "Billing Date") until you cancel your subscription or your account is terminated.
For Lifetime Licenses, your payment method will be charged as a single, non-recurring, lump-sum transaction at the time of purchase.
PawTracker offers a Free Plan allowing Users to explore core functionality capped at tracking up to three (3) active animal records. The Free Plan requires no credit card submission and carries no recurring commitment.
Monthly Subscriptions are provided on a month-to-month basis with no minimum term commitment. You may cancel your subscription at any time pursuant to Section 6.
A "Lifetime License" or "Lifetime Access" grants you access to the Service and its available features for as long as the Service is commercially maintained, operated, and made publicly available by PawTracker (the "Commercial Lifecycle").
A Lifetime License does not mean the lifetime of the User, nor does it imply an indefinite guarantee of availability. In the event that PawTracker decides to permanently cease operations, discontinue the platform, or undergo liquidation, PawTracker shall have the right to terminate Lifetime Licenses without liability, refund obligations, or compensation, subject to providing reasonable advance notice when commercially feasible.
You may cancel your Monthly Subscription at any time directly through your account administrative dashboard or by contacting us at contact@pawtracker.fr.
Cancellation of a Monthly Subscription will take effect at the end of your current paid monthly billing period. You will retain full access to the Service through the remainder of that paid period. You will not be charged on the subsequent Billing Date.
Except as explicitly required by mandatory law, all payments made to PawTracker are non-refundable and non-creditable.
We do not provide prorated refunds, credits, or fee adjustments for partially used subscription months, unused tracking slots, or early cancellations.
Purchases of a Lifetime License are final and non-refundable upon order completion and immediate provisioning of digital access to the platform.
PawTracker may, in its sole discretion, evaluate requests for refunds in exceptional circumstances involving billing errors or technical platform faults attributable solely to PawTracker. Any refund granted in such instances shall be a gesture of commercial goodwill and shall not establish a binding precedent.
If a recurring payment attempt for a Monthly Subscription fails due to card expiration, insufficient funds, or any other reason:
Failure to resolve outstanding balances may lead to account termination and deletion of Customer Data in accordance with our data retention practices.
An electronic invoice or receipt is automatically generated after each successful payment and sent to the primary email address associated with your Account. Where available, historical invoices can also be viewed and downloaded directly from your account administrative portal.
The limitation of liability provisions set forth in our Terms of Service apply fully to all purchases made under these Terms of Sale.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAWTRACKER’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY SUBSCRIPTION, LIFETIME LICENSE, OR PURCHASE SHALL BE STRICTLY LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO PAWTRACKER FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
PawTracker reserves the right to update or modify these Terms of Sale at any time. The Terms of Sale in effect at the time of your initial subscription or monthly renewal shall govern that transaction. Material updates affecting ongoing monthly subscriptions will be communicated with reasonable notice prior to taking effect.
These Terms of Sale and any claims or disputes arising out of or related to billing, payments, or subscriptions shall be governed by and construed under the laws of France, without regard to conflict-of-law provisions.
Any legal dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of PawTracker's registered seat (Lille, France).
